DMCA Policy
Digital Millennium Copyright Act (DMCA) Copyright Infringement Notification Policy for Transparent Clock.
1. Respect for Intellectual Property
Deep Dey / QuickLink ("we", "us", "our") respects the intellectual property rights of others and expects users of Transparent Clock ("the Software") and the website clock.qlynk.me ("the Website") to do the same.
We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.
This policy describes the information that should be present in DMCA takedown notices and counter-notices, and the procedures we follow when processing such notices.
2. If You Believe Your Copyright Has Been Infringed
If you believe that content on our Website or within our Software infringes upon your copyright, you may submit a DMCA takedown notice. To be effective under Section 512(c) of the DMCA, your notice must include the following information:
- Identification of the copyrighted work: A description of the copyrighted work you believe has been infringed. If multiple works are covered by a single notification, you may provide a representative list.
- Identification of the infringing material: A description of where the allegedly infringing material is located on our Website or within our Software. Please provide specific URLs or file locations to help us identify the content.
- Your contact information: Your name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Your signature: Your physical or electronic signature.
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Please ensure your claim is legitimate before filing.

3. Our Response to DMCA Notices
Upon receipt of a valid DMCA takedown notice, we will:
- Review the notice to verify it contains all required elements.
- Take prompt action to remove or disable access to the allegedly infringing material, if appropriate.
- Notify the user who posted the material (if applicable) that we have removed or disabled access to the material.
- Provide the user with a copy of the takedown notice, including the complainant's contact information (unless otherwise requested).
Note: Since Transparent Clock is primarily a desktop application with the source code hosted on GitHub, alleged infringements may involve code, documentation, website content, or media files. We will assess each claim on a case-by-case basis.
4. Filing a DMCA Counter-Notice
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notice. To be effective under Section 512(g) of the DMCA, your counter-notice must include:
- Identification of the removed material: A description of the material that was removed or disabled, and the location where it appeared before removal.
- Statement under penalty of perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your contact information: Your name, address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the jurisdiction where we are located, if you are outside India), and that you will accept service of process from the person who filed the original DMCA notice or their agent.
- Your signature: Your physical or electronic signature.
Counter-Notice Submission: Send your counter-notice to the same email address: a@qlynk.me with the subject line "DMCA Counter-Notice - Transparent Clock".
5. Our Response to Counter-Notices
Upon receipt of a valid counter-notice, we will:
- Forward a copy of the counter-notice to the original complainant, informing them that we may replace the removed material or cease disabling it in 10-14 business days.
- Replace or restore access to the removed material within 10-14 business days following receipt of the counter-notice, unless our designated agent receives notice from the original complainant that they have filed a court action seeking an injunction to restrain the user from engaging in infringing activity.
6. Repeat Infringers
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating access for users who are repeat infringers of intellectual property rights.
If we receive multiple valid DMCA notices regarding the same user or content, we reserve the right to:
- Permanently remove the infringing content.
- Suspend or terminate the user's ability to contribute to the project (if applicable).
- Report repeat infringers to appropriate law enforcement or intellectual property authorities.
7. False Claims
Warning: Filing a false or fraudulent DMCA notice or counter-notice is a serious matter. Under Section 512(f) of the DMCA:
"Any person who knowingly materially misrepresents under this section (1) that material or activity is infringing, or (2) that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by a service provider, who is injured by such misrepresentation."
Please be certain that you have a legitimate claim before filing a DMCA notice or counter-notice.
8. Limitations of This Policy
This DMCA policy applies specifically to copyright infringement claims under U.S. law. For other types of intellectual property disputes (e.g., trademark, patent, trade secret), please contact us directly.
This policy does not cover content hosted on third-party platforms (e.g., GitHub, Uptodown). For content hosted on those platforms, you must file your DMCA notice with those platforms directly.

10. Modifications to This Policy
We may update this DMCA policy from time to time to reflect changes in law or our practices. Any changes will be posted on this page with an updated "Last Updated" date.
